Mary Kate is an experienced trial lawyer and trusted business advisor who concentrates her practice on representing employers and employees in a variety of employment matters, including discrimination, retaliation, wrongful termination, whistleblower, severance/separation, employee classification, wage and hour, health and safety, and employee leave matters. Her practice spans a variety of industries, including higher education, nonprofit organizations, life sciences, chemical manufacturing, technology and financial services. She has litigated employment cases before the Massachusetts Commission Against Discrimination, the EEOC, and in state and federal courts throughout New England.

In addition to her employment litigation practice, Mary Kate counsels companies and executives on all aspects of the employment relationship and on employment issues related to mergers, sales and acquisitions. She also helps clients develop personnel policies and practices that achieve their business objectives and comply with applicable law. Mary Kate has been certified by the Massachusetts Commission Against Discrimination as an EEO trainer in the area of Harassment and Discrimination Prevention.

Mary Kate also maintains a business litigation practice and represents a broad spectrum of clients in litigation related to, among other things, contract disputes, noncompete and non-solicitation issues, complex indemnification matters, environmental, health and safety claims and intellectual property disputes.

No matter what court or phase of civil litigation her clients find themselves in, Mary Kate is prepared to advise on case analysis and strategy, discovery, trial preparation, trial and arbitration, settlement and appeals.

Prior to joining Burns & Levinson, Mary Kate served as a law clerk to the Honorable Rosemarie Annunziata on the Virginia Court of Appeals, practiced in Washington, D.C., and worked at a national litigation firm in Boston.

Experience

Experience

  • Served as trial counsel in a complex commercial dispute in federal court (SDNY) that resulted from a multi-billion dollar acquisition of chemical manufacturing facilities throughout the world. Mary Kate litigated 30+ safety, health and environmental claims related to the OSHA Process Safety Management Regulation (and its subsections relating to mechanical integrity, facility siting, process safety information and emergency action plans), the OSHA General Duty Clause, equivalent health and safety laws in the United Kingdom, Canada and Europe, and environmental remediation and permitting issues in the U.S. and abroad. After three weeks of trial, the team obtained a favorable settlement on behalf of the client.
  • Won dismissal on all counts for a multi-national car sharing company in the New York Supreme Court in connection with claims related to a customer’s business account.
  • Successfully defended former directors and officers of target company in connection with claims for indemnification related to acquisition and due diligence.
  • Negotiated favorable settlement for a digital commerce company in connection with breach of contract claims arising out of e-commerce site development agreements.
  • Negotiated favorable settlement for a partner involved in a dispute arising out of the dissolution of the partnership and disbursement of assets, including multiple real estate holdings.
  • Obtained a multi-million dollar verdict for a child who was injured on an escalator in China. The verdict was reported as the tenth largest in Massachusetts in 2007.
